At Neufeld Legal P.C., we understand that farmers and landowners are entering into lease negotiations with energy providers at a considerable disadvantage. This disadvantage is evident from the outset, with these companies having experienced personnel highly knowledgeable in the solar industry, having conducted such negotiations on multiple occasions, both in Alberta and elsewhere in Canada and the world. Furthermore, they draw upon outside professionals (lawyers, accountants, bankers, etc.) who have many years of experience in not only negotiating these leases, but also in drafting the solar option and lease agreements to their advantage. And most significant, they control the purse strings with respect to funding the construction of the particular solar project, such that all the advantages would appear to be in their favour.

Although this all might be true, it doesn't mean that you shouldn't pursue better rates and a better arrangement with respect to the leasing of your farmland to the solar energy operator. For even though the above-stated advantages will not change, you can at least seek to lessen their impact by retaining the appropriate counter-weight to their enormous power. And even though this counter-weight can never balance out the inequality of bargaining positions, it can prove important in negotiating a better arrangement and higher lease rates. That is what we strive to provide to our clients who are seeking to lease their farmland or other viable property to solar energy operators, while recognizing that these companies still hold the final decision. But should you be selling yourself short or should you be pursuing a better deal by engaging a law firm capable of advancing your best interests.

For legal services pertaining to the negotiation of lease rates and solar option + lease ageements as to your farmland with a solar energy operator in the province of Alberta, contact solar energy lawyer Christopher R. Neufeld at or by telephone at 403-400-4092.
